MFT-2026-04 Temporary Waiver of State Dyed Fuel Penalties

Due to ongoing global conditions affecting diesel supply and elevated diesel prices, Governor Brian P. Kemp issued Executive Order 10.06.26.01 authorizing the Georgia Department of Revenue to provide relief related to the use of dyed diesel fuel for highway purposes. To carry out the Governor’s Executive Order, the Department of Revenue is providing a waiver of state penalties related to the use of dyed diesel in on-road vehicles in all 159 counties.
O.C.G.A. § 48-2-43 provides the State Revenue Commissioner with the authority to waive, in whole or in part, the collection of certain statutory penalties when he determines such waiver is reasonable. Commissioner David Burge hereby temporarily waives any state penalties incurred for selling or delivering any dyed fuel oil and for consumption of dyed fuel oil that is consumed in on-road vehicles or for highway use under O.C.G.A. § 48-9-16(e). This waiver is effective October 6, 2026, and terminates at 11:59 p.m. on November 5, 2026.
