Audit Interest Charges - FAQ

  • I just received this notice. Why am I being charged interest?

    Interest is charged on any tax not paid by the due date of the return.

    O.C.G.A. §48-2-40 provides that taxes owed the State shall accrue interest from the due date of April 15th until the date of payment.   

    O.C.G.A. §48-7-81 states that if any amount of tax imposed by this Chapter is not paid on or before the last date prescribed for payment, interest on the payment at the rate specified in O.C.G.A. §48-2-40 shall be paid for the period from the last date prescribed for payment to the date paid.  

    O.C.G.A. §48-2-41 provides that interest can only be waived where the delay causing the interest is due to the action or inaction of the Department. 

  • Can the interest be waived?

    Under Georgia law, interest can only be waived if the Department of Revenue made an error that caused you to owe additional interest.

    If you omitted income from your original return, the error is not considered the Department’s.
